Terms of Service
How sessions are scheduled, run, and adjusted — and what we ask of every family.
Getting Started
- Sessions are scheduled collaboratively between the coach and the family, at a cadence appropriate to the program.
- The program window begins on the date of the first scheduled session and is not extended for missed, canceled, or forfeited sessions unless otherwise agreed in writing.
Supervision & Session Environment
- For in-person sessions at the family’s home or another private location, a parent, guardian, or responsible adult 21 or older must be present in the home for the entire session. This is non-negotiable — sessions will not proceed without it, and any such occurrence is treated as a late cancellation.
- We ask that the session space be reasonably quiet and free from distractions, with the student’s materials, devices, and assignments ready at the start.
Session Conduct & Punctuality
- Sessions begin at the scheduled time. If the student isn’t ready to begin within 10 minutes, the session proceeds for the remaining time — no extension is given for time lost to a late start.
- If the coach is delayed, equivalent time is added to the session, or a make-up is offered at no additional charge.
- Students are expected to be fully present — phones silenced, social media closed. The coach may raise recurring engagement concerns directly with the family.
Cancellations, Rescheduling & Missed Sessions
- Free reschedule with at least 24 hours’ notice. Rescheduled sessions must occur within the program window.
- Late cancellation (under 24 hours’ notice): 50% of the session value.
- No-show: the full session value is forfeited.
- Genuine emergencies — serious illness, hospitalization, family crisis — may have these fees waived at the coach’s discretion. Please notify us as soon as possible; documentation may be requested.
- Forfeited sessions are not rescheduled or added back to the program. The program window does not extend to accommodate missed sessions unless otherwise agreed in writing.
Inclement Weather
- In severe weather, dangerous road conditions, or an active weather advisory, we may convert an in-person session to online (Zoom or a comparable platform), with as much notice as possible.
- If your family would rather not meet online, the session can be rescheduled at no charge, provided we hear from you before the scheduled start time.
- Neither party is penalized for a good-faith weather-related cancellation.
Online Sessions & Technical Matters
- Any session disrupted by a failure on our end is rescheduled at no charge.
- We ask that you have a reliable connection and a working device ready before each online session. Repeated disruptions on your end may lead to a recommendation to move to in-person sessions.
- If a connectivity issue comes up in the first 5 minutes of a session, let us know right away — we’ll make every reasonable effort to resume or reschedule.
Staying in Touch
- We’ll text at least 24 hours ahead of each session to confirm.
- A reschedule is only available with at least 24 hours’ notice, or in a qualifying emergency or weather situation.
Working With Schools
- Clarity Academics takes a collaborative, whole-student approach, which may include communicating with your student’s teachers, counselors, or other educators when appropriate.
- This is encouraged, not guaranteed — not every school or educator is able to engage with an outside coach, and we can’t promise that collaboration will happen.
- We will never contact school staff or any other third party about your student without your express written permission.
- We may ask for access to grades, assignments, or academic portals to support the coaching relationship, and appreciate your help providing it.
- Coaching is a collaborative process. We bring expertise, structure, and genuine care to every session, but your student’s growth depends on their own engagement and effort — we don’t guarantee specific grades or test scores.
Program Terms
- Clarity Breakthrough runs on a 30-day program window and concludes at the completion of all sessions or the expiration of the window, whichever comes first. It does not renew automatically.
- Clarity Formation runs on a 90-day program window, on the same terms.
- Clarity Momentum renews automatically each month. Either side may give written notice at least 7 days before the next billing cycle to not renew. There’s no long-term commitment — it continues for as long as it’s serving your student well.
Confidentiality
Everything shared during the coaching relationship is held in strict confidence, and we won’t disclose it to a third party without your express written consent — except where the law requires it, or where we believe a student or others may be at risk of harm. See our Privacy Policy for more.
Independent Contractor
The coach operates as an independent contractor, not as an employee of your family, your student’s school, or any affiliated institution, and is solely responsible for their own taxes, insurance, and statutory obligations.
Liability
Clarity Academics provides academic coaching in good faith and with professional care. We’re not liable for indirect, incidental, or consequential damages arising from the coaching relationship — including academic outcomes, school disciplinary matters, or college admissions decisions. Coaching is a support service, and results depend on many factors beyond our control, including your student’s own effort and engagement.
Governing Law
These terms are governed by the laws of the Commonwealth of Kentucky. Any disputes are resolved in the courts of Fayette County, Kentucky.
Policy Updates
We may update this page at any time, and will give notice at least 14 days before changes take effect. Your signed Service Agreement itself can only be modified in writing, signed by both parties.
